AN OPEN LETTER TO THE MODERATOR

An Open Letter to the Moderator of the Syn of the CSI & Syn Nominee on the Governing Council of the American College,  & Chairperson of the Selection Committee for the Appointment of the Principal appointed in 2011, now quashed by the Madras High Court Bench, in Madurai

Knowing full well that you are determined to stay on course resorting to fraud and manipulation, as Christians motivated by our Lord's parable of the Importunate Widow and the Unjust Judge who neither feared God nor cared for people,  we have decided yet once more to write to you to call you to repent.

   In as much as you were the Chairperson of the Selection Committee which declared that among the 7 candidates interviewed Mr. Christopher Davamani was found to be the best and most suitable candidate to be the Principal of the American College at the very outset we would like to ask you "Are you not ashamed that the High Court Bench in Madurai has ordered the appointment and the approval granted by the University to be quashed through a common order?" And, do you not feel guilty for having Discredited God's Name so badly?

   The grounds on which the order has been passed calls into question the very credibility of the Church as a whole.  We cite below just a few of the very damaging comments passed by the honourable judge, 
    He has observed that the marks obtained by the two candidates in the written examinations they passed were not at all taken into consideration.  The reason for this cover up is obvious as we present below the tabulated comparison as recorded in the order:

The following remarks of the Honourable Judge in summary form are noteworthy
1.  It was proved that that the marks of the written examinations were not before the Committee (you, sir, were in the Chair)
2.   The Candidate himself was party to the selection of the Selection Committee by the Governing Council.  And so he had influenced the selection both on account of him being a member of the Governing Council and being the son-in-law of the Bishop who was the Chairperson of the Governing Council.
3.  Therefore the appointment deserves to be set aside on the principle that no man can be judge in his own cause.
4.  The selection process, therefore, can be safely said to be totally arbitrary, thus violative of Article 14 of the Constitution of India.

   Sir,  you have spoken of the bishops of the CSI as Men chosen by God.  You have also declared yourself to be called by God to the high office of Moderator.  Our memories are not short as we remember exactly how you went about securing votes for you and your team mates.

   We are confident that your memory too would not have faded so soon.  In order to gain votes of the DM & R candidates for you and your team mates at the Synod held ten months ago, last year you struck a deal with the then bishop of the Diocese since deceased, late Christopher Asir and play acted being Chair of the Selection Committee to declare Mr.Christopher Davamani as the best of the seven candidates to be made Principal of the American College.   The Madras High Court Bench has struck this selection down, and has also quashed the approval granted by the University.   This is no news to you but we want to remind you of the shady deal which made you declare the least suited man to be the best just for the sake of the votes to establish God's call to you to be the Moderator!

     In former days when a severe well reasoned indictment is made against any leader of the people,  the leader resigned admitting that he had brought discredit to his office by indulging in wrong doing  with vested interests.  Can we expect any such response from a person who claiming to have been chosen by God has defamed God's Name beyond measure?

   But if you stay on in office in spite of having been proved to have played along with a manipulative scheme just for your own advantage, can we at least see a change in which you do things hereafter?

    The courts are yet to decide which is the proper Governing Council.  But you have participated in the illegitimate council meetings from Feb 2010 onwards as the Nominee of the Synod.   You were warned about this through telegram and letter but you chose to ignore them. It was in this capacity sitting as Synod Nominee on an illegitimate body that you acted as Chair of the selection process.

  Since becoming your own commissary and assuming all the powers of the bishop of the DM&R you have gone ahead and convened the illegitimate College Council and have pressurized the members of the College Community who were opposed to the Diocesan bid to take over the College to sign a memorandum of understanding, the retired principal playing turncoat, trying to grab power of some kind under the presumption that the College is now an institution of the Diocese.  That is, you continue to indulge in wrong doing irrespective of whether you bring credit or discredit to God's Name.  That consideration does not seem to weigh with you at all.  

    Anyway, as stated at the outset, we like the Importunate Widow of our Lord's parable are knocking at your door for justice to the 133 yr old institution which has served the vision of the founders until forces of power grabbing for personal gain gained control over the institution.

   We shall go on praying for you, the Synod of the CSI and the American College...

By the grace of God our prayers are already answered through fair judgments at the courts of law.  We do hope that the representatives of the Heavenly Court on earth also will follow suit,

    When the High Court itself has quashed the decision of the 'Council,' why should this Forum lament on what the 'Council' failed to do. The first part of the 'open letter' presumes that the 'Council' is a legal body and that only the selection process is illegal. This is the stand of the petitioner! How does the Forum differ from him? The second part of this epistle refers to the illegality of the Council. Why didn't the Forum implead itself in the High Court case arguing that the Council is illegal? Oh, I'm sorry the locus standi problem will crop! Third, can the Forum or one of its members who has served the college and acted as Vice Principal explain why the 'open letter' now chooses to talk loud about the written test marks in the test conducted by the Sub-Committee or arrears that a candidate had in courses of study? Was Samuel Sudanandha selected or elected? Was Chinnaraj Joesph Jaikumar selected or elected? What happened to their written test marks? What did the then faculty reps with responsibility do when the then Bishop-President put all the ballot papers into his cassock pocket & left with a concluding prayer? Did the faculty reps go to court or said amen and ate briyani and belched? Did the faculty reps in the Council that elected Chinnaraj Joseph Jaikumar demand the written test marks or say amen to the election verdict of the bishop? How about the retired faculty members or those who are serving who have passed their qualifying exams either in low grades or in attempts? People with low grades and attempts can be recruited as teachers in the American College and act as vice principals, bursars, & controllers, but NOT as the Principal! OK, even it is so, the petitioner has highlighted this in his petition. What does this 'open letter' or 'closed letter' for that matter serve now? For public consumption? Physicians, heal thyself first!!

    It was a dull Wednesday afternoon; “Implications of the Disintegration of the USSR” was the topic for discussion at the faculty intercession in our vestry. Dr. D. Peter Jayapandian, the Principal—who made it a point to attend intercessions with his officers—Introduced the speaker: Dr.Carr as a renowned theologian; the rest is memory to cherish. I can recall almost all his speeches—delivered as sequels—in adjacent weeks. He impressed the audience with his depth, flow, clarity—and above all his sincerity and commitment to the ideas that he enunciated.

    I do appreciate him for the same sincerity that I find in this letter as well questioning the Moderator and the way he is troubling the college. The Forum has been lending unstinting support to the college since the outbreak of the problem—irrespective of the question who leads the college or the struggle. While endorsing the queries that the writers raise in the letter I also thank them for the gesture which is reassuring at a testing time as this.

  3. My views may be condemned as views of idealism. Nevertheless it is the establishment of idealism that makes people write simple stories. It is far better to read simple idealistic stories like that of Premchand which inspire us instead of reading true stories from the detective digest that leave a bad taste in the mouth. The American college is in the process of writing her own unfortunate story at present, steering through turbulent weather nearly for the past five years. As members of the faculty are we optimistic participants or mute spectators? No doubt all of us have personal commitments. Should it deter our actions? Even if it is in a very small way let us consider participation despite everything.
    In this regard, I really admire the contribution of the former members of our faculty who have retired before the crisis. Those that have had concern for the college have been speaking in one accord right from the beginning of the crisis. I have never observed them as selfish or fake. This is a testing time when parts of the turbulent story need to be revisited and the facts and figures have to be brought to light in order to concretise the future course of action. This is exactly what the forum has intended.
    When there was a crisis, it was Dr. Carr who was one among the early birds to arrive on campus. I observe his participation in the American college story as an idealistic character – a man of simple, straight forward demeanour. One may defer with his views, yes, we have the liberty to do it with a vengeance, but definitely, definitely not when his commitment is towards a good cause. This statement of mine has adduces to defend it. As the Chaplain of the college I have cherished memories. When the person arranged for the chapel service did not show up for valid reasons at the last minute, with the least beck and call Dr. Carr was always available to do His mission, whether to deliver a message or to celebrate the Eucharist. Do not quickly come to conclusions as we always do! He was an international figure with a lot of social commitments. Still he is as busy as ever. The other occasion that I remember is the staff retreat at Holiday Inn, Kodaikanal. When there was a crisis for a retreat leader on the second day, with the consent of the then Principal, I requested Dr. Carr to help, over the phone late in the night. He said “Professor Barnabas I have just returned from Jaffna, of course I could come over there. At what time would you have the communion service?” I said “ 7a.m.”
    I was able to see a tall figure with an intellectual stoop moving through the mist with the characteristic brisk walk at six in the morning. One can imagine at what time he would have started from Madurai to reach Kodai! Recently I learnt that integrity is a bigger word than honesty. In my opinion Dr. Carr has the attire of the former. I can write equally of Prof. Samuel Lawrence and Mr. Sathiamoorthy.
    I appreciate your participation in The American College story and admire your attitude of calling a spade a spade, but still my friend John, let us be a little polite in our expression if not for anything else but for their age, experience and reputation. Why should we be concerned about the ‘locus standi’? If there is any other stronger phrase than this that offers them the liberty of expression, let us recommend it as an American College community. After all they are simple personalities in the Idealistic story of The American College. I sincerely feel that we do not match them in any way, at least as of now.
    I am a persuasive Indian but not an argumentative one. These are my views.

  7. i am just curious - when are we to expect a verdict on the legitimate college governing council. with that, not decided, who is calling the shots (a game - free for all - we watch in utter dismay) ... so sad to see the college's plight.

  8. Dear Reuban: Many friends of the College fell the same way as you feel. The problem is with our judicial system. It is slow and the people comfortable with the system don't seem to be worried.
