A BRIEF NOTE ON THE LEGAL CASE

A case had been filed by the Bishop & Co. in the Madurai High Court.

Their prayer was to order the Commissioner of Police of Madurai to evict the “unlawful” presence of the Principal Dr. Chinnaraj Joseph who had been suspended by a resolution of the Governing Council, convened by the Bishop and to help Dr. George Selvakumar to officiate as Principal.

The case was heard on April 29, 2008. The prayer has been dismissed. Once the official judgment copy was issued it will be shared here.


SOME SNIPPETS:

• The Judge asked what were the other avenues they had tried before coming to this court.

• When their counsel was talking about the Governing Council and its resolution, the Judge asked where the meeting was conducted; was it in any Hotel.

• The Judge asked for the original minutes of the meeting and for the resolution. It was replied that those evidences were all in the diocesan office.

• The Judge deputed two young advocates to rush to the diocesan office and to get the minutes immediately.

• The minutes note produced was a simple one-quire note book.

• The minutes were signed by “eight” Governing Council members.

• However the resolution was signed only by the Bishop and the “Secretary”, George Selvakumar. Judge asked the reason for this. But there was no answer from that side.

• The resolution was not accepted by the court.

• Hon Judge has issued an order that government officials (R.D.O.) have to monitor the daily routine of the college.

• Both the parties should not do anything that can harm the routine functioning of the college.

• The authority of the Bishop to convene the GC, the authenticity of the signatories of the GC meeting and the veracity of the signatures – all have to be contested in another case.



A friend commented: We have not won anything; but they have lost their case.

Background:

It is rather painful to revisit those moments that have stunned the course of history of the American College. The main thrust being the ownership of the college. The sudden turn of events converge at one point, Church of South India (CSI) Diocese and its representative, Bishop Christopher Asir claiming ownership over the property of American College.

Bishop Christopher Asir is propagating that American College belongs to the CSI Diocese and property of the Church, which it never can be! Then! It belongs to whom? It belongs only to the Governing Council of the American College which is registered as a Society. Diocese has no claim over it. Historically….
A brief history of the American Madura Mission:
American Madura Mission was started in Madurai in the year 1834 (just 33 years after Madura had fallen to the British in 1801) with a purpose mainly to build schools and to train natives of missionary labour. There were about 30,000 people in Madura city and some 20,000 in nearby villages.
A group of American Missionaries under the American Jaffna Mission decided to expand their mission activities to the Tamil speaking neighbouring continent. The first person to land in Madurai via Devapattinam (now Ramnad) was Levi Spaulding, sent by the Mission to find a suitable place for setting up Mission centre. It took twenty days those times to travel from Ceylon to Madura by sea and missionaries had to travel 135 days from Boston to Madura. Most of the Missionaries faced the hardship of travelling longer times, risking their lives to rough seas and diseases associated to sea travel.
Todd, Tracy, Poor, Chandler, Rendell, Herrick, Noyes, Doak, Taylor, Whitin, Banninga, Capron, Washburn, Zumbro, Wallace and the Scudder family have all sacrificed their life undergoing hardship and adversities of famine, tropical diseases and death for the sake of their love to educate the native brethren who were mostly illiterate, poor and depressed at that time.

American Board of Commissioners for Foreign Missions (ABCFM) started the American Madura Mission in 1834 and started missionary services in Madurai and Ramanathapuram districts. It went about starting schools trying to educate natives, starting seminaries to train natives in preaching the gospel and building churches to propagate Christianity.

One such institution is the American College, originally started as a mission school in Thirumangalam, which was later shifted to Pasumalai and austerely developed by Rev.Washburn. The Mission had purchased the 14 acres of the Pasumalai land for Rs.400 those times and the then Collector Blackburne had given 20 kawnis of land appreciating the Missions services. What is now the Pasumalai School was initially housing the American College which was started in the year 1881 with just four students.

With a noble vision to take education closer to its people, the American College was moved to its present site in 1904. By this time American College had been incorporated into the Board of Trustees in the State of New York for which Rev.Zumbro later became the President.
The noble vision was fulfilled as the board contributed $ 32, 000 in 1905 and a two storied college Hall ( main hall) was constructed with $ 16,150 in 1907-08. The 75th anniversary of the American Madura Mission saw the American College new and buoyant. Rev.Zumbro succeeded Rev.Washburn and became the first Principal in the new site.
In 1914 American College was recognised by the Madras University as a first grade college and started receiving government aid. With a sole aim to provide greater independence and autonomy to the college, the board in 1931 deliberated over separating American College from the Mission department of the American Madura Mission. This move involved intense debates and in January 15th 1934, the Governing council of the American College was created and American college was registered as a Society in 27.6.1934. Since then the Governing Council of the American College has become a legal entity and took up the entire administrative responsibility of the College. However, two American boards were acting as Controlling Agency of the American College property till 1972. One was United Church Board for World Missions (UCBWM), which even now contributes lakhs of rupees every year and crores of rupees for special developments and the other was The Board of Trustees of the Endowment Fund for the American College which is not attached to any Church but was started in 1920s by an old student of Oberlin College and scientist Charles Martin Hall (1885) with his own money. These two boards handed over their roles as the controlling agencies valuing the leadership of Indian educationists in 1972. This gives us a clear understanding about their broad ideas about liberal higher education.

Handing over this administrative independence and legal autonomy and independence to administer and govern property to the Governing Council of the American College has not altered the Christian Character of the American College and has never ignored or undermined the representation of the CSI Diocese. Out of 14 members in the Governing Council 3 representative membership has been given to the church.



  • The Bishop of CSI Diocese is just a member and chair of the Council and he doesn’t have any executive powers.
  • Only the Secretary who is also the Principal of the college has executive powers.
  • He (the Principal) is also the secretary to the Governing council with executive powers.
  • The Principal and Secretary is the only person given with administrative responsibilities.
  • The Bishop or the CSI Diocese that he represents can not interfere with the day to day administration of the American College.
If the Bishop is not able to attend the Governing council meeting, which the Secretary can only convene, he can not even send his representative on his behalf. Instead the Governing Council can choose a non-teaching GC member as the chairman.

American College and CSI Diocese

When CSI was formed in 1949 the American Madura Mission like other Missions joined with the CSI. But American College never joined with the CSI and is never a part of the CSI Diocese. Its sole authority is the Governing Council. The Bishop has got nothing to do with the college except being a chairperson in the Governing Council.

Bishop Christopher Asir’s Unlawful Claims!

Bishops unnecessary, unlawful, unconstitutional claims should not hide this essential truth that he has got nothing to do with the American College administration. He (the Bishop) is an outsider. If we (the people of The American College) fall prey to his lies it is a great loss to Christians, Christianess and Christianity and the betrayal of goodwill of the missionaries who started the American College. It should also be known that the American Madura Mission was practising Christian inclusiveness, tolerance and were pluralistic in their approaches to educate and uplift to benefit mostly those who were depressed and downtrodden
Will the Bishop, who is interested in appropriating the American College, explain how the CSI church has contributed to the American College?

Many Hindus and Muslim friends have donated for buildings in the college. The Tamilnadu government and University Grants Commission provide crores of rupees towards staff salary and students welfare. CSI church has not given a single penny for the American College. The present Bishop doesn’t have the habit of giving. The whole world knows that he has the habit of taking away what is not rightfully his. We cannot Sacrifice the American College to this Selfish interest of the Bishop.

A painful note.........

It should be borne in mind that the sacrifices that the missionaries had made those adverse times were to benefit mostly those who were depressed and downtrodden, trampled by the hostile forces and enslaved by oppressive systems of such times. Missionary education has provided meaning to millions of such lives over the years and I am here writing this to you only because of the sacrifices made by the Missionaries of the American Madura Mission. If not for them who else ?……….. the depressed classes would have continued to be depressed and education would always have been a distant reality to many.

Even today the American College Cherishes those good values and practices inclusiveness in education with a vision to develop in students, even from underprivileged background, the capacities to become a global citizen.
This we believe. This we will die for……..

IPAC's PUBLIC MEETING

Though IPAC - INITIATIVE FOR PROTECTING AMERICAN COLLEGE - took a decision on 12th itself to have a public demo of some sort the dates for that were getting postponed due to many a local situation. It was first Chitrai Festival and then another local problem at the Thevar statue. But these postponements have worked to the good of IPAC. Because the meeting on 25th was held in a better and politically significant spot of Madurai – the junction between West and North Masi Streets.

Image and video hosting by TinyPic Proper arrangements were well made and by 5.45 the meeting was started with MUTA Parthasarathi, an alumnus as the master of the ceremonies. His well meaning presence will have its own advantage since he represented and is the undisputed leader of the Madurai Kamaraj University Teachers’ Association.

He reiterated how individual interests should not in anyway mar the reputation and legacy of the Great American College. He strongly condemned the misdeeds and ulterior motive of the Bishop and his coterie.

Prof Winfred, former H.O.D. of Zoology Dept. then gave his Chairman’s address, reminiscing the old and historical facts which show the magnanimity of the earlier Bishops who stood for the greatness of the college always.
His whole speech brought out his deep anguish for the present happenings in contrast to the greatness of the clergy who stood by the college and its reputation in the long history of our college.




This was then followed by a galaxy of political leaders of all hues. They in unison gave their wishes to IPAC to succeed in its efforts and also their unstinted support for safeguarding the institution. They all crossed the political barriers and showed their unanimous support. Many speakers pointed out that how each party had some link with the college. Another common aspect of their speeches was that if Meenakshi Temple is a place of pride for every one of this town so also The American College is for every Maduraite. Like a place of worship this college in the service of all without making any difference of caste, religion, creed is to be equally revered and held in high esteem by all, they said. Some of them were our alumni and their profound interest and concern for the college was very explicit and reflexive


The final and climactic part of the meeting was the speech by Prof. Solomon Pappiah, former professor of Tamil. Missing was the roaring voice of Pappiah on that day. It was so emotionally choked. But he brought out not just vociferous accusations, instead showed the public the photocopy of a land deal as an example and evidence to show how the present Bishop of Madurai-Ramnad diocese had sold some properties of the diocese. He also pulled out another sheet, a photocopy of the letter sent by American Board of Trustees of The American College. He read out one paragraph from that letter explicitly condemning the act of the Bishop and standing by the College and praising the Principal for his firm stand.

The Biblical story of Goliath and David he narrated was apt to the situation. The muscle and money power of the Bishop and his coterie cannot deter the will of those who are behind the welfare of the college. Like David with his simple sling, IPAC can win this war against the mighty Bishop with the blessings of the Almighty, he averred. His usual well-known powerful oration, tinged with emotion and deep anguish this time, made the speech more pointed and poignant coming from his heart, and touched the audience very much.

I remembered Pappiah giving a very serious and inspirational speech inside Madurai Central Jail nearly thirty years back. That was during a MUTA strike. A large number of college teachers of Madurai University were fighting for their rights and fulfilling the high command’s order of ‘fill the jail’. That speech was so great on that day inside the jail that I still remember it and it was instrumental in making many of the staff from various colleges think seriously about their profession and rebellious spirit every teacher should have. If that was kindling the brain of colleagues from various colleges then, this time it was the heart of the audience Pappiah targeted. And he proved this time also that he could take the avatar of the fabled Pied Piper effortlessly.

Since the time allotted by the police for the meeting was up, with Parthasarathy’s single word of thanks the meeting came to an end. Anyway that is the end of the meeting only ....

ON AMERICAN COLLEGE SITUATION FROM SOME DISTANCE AWAY

While the 'dharna' and the 'watch' organized by the retired faculty, alumni/alumnae and other active well-wishers of the American College are good, these may not by themselves be adequate to restore the status quo ante at the College. The highest Court of Justice in Madurai may have to be approached for a judgement that the recent actions of the Chairman of the AMC Governing Council are unconstitutional, therefore illegal and so liable to be overturned by the Court.

If the Church is determined to take over the College, it will bide its time until the forces of opposition tire and fizzle out. For how many nights and days can the 'watch' and vigil be maintained! That is why they are inadequate. But I applaud what is being done to save the College.

It is all very grim. I feel very sad for the College that I served for 38years. I remember the wonderful times I had. But I am some distance away now and can only imagine what is going on. Let me from where I am wish the College well and hope that the College would be saved.

MADURAI: After two days of high octane activities witnessed at the American College, things returned to normality on Monday. Examinations were conducted and peace prevailed on campus.
It all happened following apprehensions raised on the likelihood of a takeover of the college by the Church of South India’s Madurai-Ramnad Diocese. Peace talks were arranged between the supporters of the Bishop, ex-officio chairman of the governing council, and those of Principal and secretary, T. Chinnaraj Joseph Jaikumar.
With the talks failing to produce any conclusive results, as assured, Mr. Chinnaraj ensured peaceful conduct of the examinations. A huge posse of policemen was posted to prevent any unsavoury incident inside the campus.

Violation of Child Rights and those dreadful moments……..




It was a tense evening in the American college, Madurai on 19/04/08 as the Bishop of Madurai and Ramnad Diocese Dr.Christopher Asir had unconstitutionally convened a Governing Council (GC) (wherein the constitution clearly states that the Principal and Secretary ONLY has the powers to convene the Governing Council and the Bishop is only the Chairman of the council) of the American College to take action against the Principal and Secretary Dr.Chinnaraj Joseph Jaikumar. The meeting was convened in the forenoon and the Principal and Secretary was unconstitutionally suspended.
Following this action, the Bishop, his son Jeba, his daughter Ms. Jyothi Christober, his son-in-law M.D Christober and his supporters tried to storm the American college and take control through unlawful means. This emotionally charged situation was aggravated by the presence of local rowdies in support of the Bishops family. American college, with a 127 year old tradition of offering Liberal Christian Higher Education to students irrespective of caste, creed and religion with secular values had never witnessed such a dreadful situation which would never fall within the purview of lawful activities. I say it as dreadful as the subsequent unfolding of events never was a testimony to the very basic values of humanness that we cherish and uphold.

The most pathetic and appalling event is the bringing of girl students from CSI Diocese managed colleges and small children to support their cause. Around fifty children, mostly boys, were made to sit outside the college in support of the bishop. Surely a violation of child rights endangering the safety and security of children. It was a busy evening as the entire Madurai was watching Edhirsevai as part of the Azhlagar festival. These children were mobilized around 7.45 PM and were from a nearby centre run by the Diocese supposedly offering rehabilitation for Tsunami affected children, mostly believed to be orphans.

The most awful, terrible and horrible nightmare to these children was to be made to sit there the whole night and watch the most painful events wherein the entire college was in an agitated mood, both sides. The children were witness to these tense moments as the Bishops supporters were all fuming with anger, abusing the Principal and his supporters, intimidating them of dire consequences, threatening the students and faculty who were in support of the college and its Principal. Those innocent children were witnessing the entry of police force strength by strength, vans and jeeps plying in and out of the college. I wonder what amount of fear this situation would have instilled in the young minds of these helpless, poor children. These children surely suffered a psychological trauma as tension prevailed the whole night. Suppose something untoward had happened, these children would have become the first set of victims as they had the only option of running helter skelter and getting lost in the crowd, from fire to frying pan.

Who would account for such an atrocious situation? Is it because the children were from very poor households belonging to the marginalized sections of the society that their rights were taken for granted and made to face the perils of angry, agitated, furious and volatile situations?

Why these children?

What amount of trauma it would have created in their minds? How would it impact on their future, their career? What role model is being provided to them?

Moreover, none of the children were aware of the situation and even otherwise they have been misguided by those selfish souls to safeguard their own vested interests. Are these kids the "family's" shield in their bid to capture Principal's office on that night? Only a cruel and scheming Machiavellian mind can bring the hapless children into a muddle like this.

This is a clear instance of violation of Child Rights……….. we have to come together to fight for this cause

AMERICAN COLLEGE ISSUE: STALEMATE CONTINUES

MADURAI: The peace committee meeting convened by the district administration to resolve the problems of The American College produced no results here on Sunday.
The college administration was in turmoil following apprehensions about the Church of South India Madurai-Ramnad Diocese attempting to take over the institution.

Under instructions from Collector S.S. Jawahar, District Revenue Officer A. Ramachandran headed the meeting attended by five members of both the factions. Representatives of both the groups were let to discuss the pending issues and to come out with a consensus.

"They came out with a statement to maintain status quo as on April 8 and promised not to involve students in the issue and continue with the examinations. The group headed by Principal and Secretary T. Chinnaraj Joseph Jaikumar agreed to it and signed, whereas the other group headed by George Selvakumar sought more time to discuss the issue and did not sign," said Mr. Ramachandran.

The head of the institution had been asked to hold the examinations and any action detrimental to the welfare of the students would be viewed seriously, he said. "We have great respect for the Government and will fully cooperate with the law enforcing agencies. We will cooperate with the Government in maintaining peace in the college keeping in mind the interest of the students. Everything is well under control and examinations will go on as usual," said Dr. Chinnaraj. The meeting was also attended by Revenue Divisional Officer S. Jeyaraj, Tallakulam Assistant Commissioner of Police (Law and order), Tahsildar (Madurai South), Tallakulam Inspector of Police (Law and order) and other revenue officials.

The meeting follows a high drama that was witnessed on the college premises on Saturday Tension prevailed inside the campus. Police personnel stepped in considering the welfare of the students and the district administration swung into action to resolve this issue.

காலை 11 மணியளவு வரை குறு அறிக்கைகளை விநியோகித்துவிட்டு, கல்லூரிக்குத் திரும்பிய போது, பிஷப் இரட்சண்யபுரத்தில் இருக்கும் தனது அலுவலகத்தில் நம் கல்லூரியின் சட்டமன்றக் குழுவை (GC - Governing Council) கூட்ட முயல்வதாகத் தகவல்கள் கசிந்தன. 12 மணிக்கு கூட்டம் நடைபெறுவதாகத் தகவல்கள் வர ஆரம்பித்தன.

மதியம் ஒரு மணிக்கு கூட்டம் முடிந்து ஜார்ஜ் செல்வகுமார் கல்லூரி முதல்வராகவும், கிறிஸ்டோபர் தவமணி துணை முதல்வராகவும், அருட்பிரகாசம் (பொருளாதாரம்) பர்சாராகவும், அலெக்ஸாண்டர் (தமிழ்) Dean ஆகவும் பதவியில் அமர்த்தப் பட்டுள்ள தகவல்கள் வந்தன. அதோடு, நம் கல்லூரி மாணவர்கள் சிலரை இங்கிருந்து (சாமி டீ கடையில் இருந்து) காரில் அழைத்துச் சென்று அங்கு அவர்களை வைத்து புதிதாக “பதவியேற்றவர்களுக்குப்” பொன்னாடை அணிவித்து, புகைப்படங்களெல்லாம் எடுத்த செய்தி வந்தது. அங்கிருந்து மதிய உணவை முடித்துவிட்டு நேரே நம் கல்லூரிக்குள் வந்து கலகம் விளைவிக்கலாம் என்ற வதந்தி பரவியது. (அதுவே அவர்கள் திட்டமாயிருந்திருக்கிறது.)

எல்லோரிடமும் பதட்டம். அங்கிங்கு என்றிருந்த ஆசிரியர்கள், ஆசிரியல்லாத அலுவலர்கள், பழைய மாணவர்கள், இப்போதைய மாணவர்கள் எல்லோரும் கல்லூரியின் கதவருகே குழுமி நின்றோம். (இது அவர்களின் திட்டத்தை மாற்றியிருக்கிறது என்பது பின்னால் நடந்தவைகளை வைத்துப் புரிந்து கொள்ள முடிந்தது.) Washburn Gate மாலைவரை இதே பரபரப்புடன் இருந்தது. அப்போதே ஒன்று புரிந்தது; நிச்சயம் மால 6 மணிவரை அவர்கள் கல்லூரிக்குள் நுழைய முயல மாட்டார்கள். அதன் பிறகு என்ன என்பது ஒரு கேள்விக்குறியாக இருந்தது.

ஆனாலும் மாலை 6 மணிவரை இப்போதைய மாணவர்கள், பழைய மாணவர்கள் அனைவரும் படபடப்போடு காவல் இருந்தார்கள். காலையிலிருந்து கல்லூரியைக் கடந்து செல்லும் அழகர்திருவிழாக் கூட்டமும், கல்லூரி வாயிலுக்கு வெளியே நிறுத்தி வைக்கப் பட்டிருந்த இரு காவல்துறை வண்டிகளும் அவ்வப்போது கல்லூரிக்குள் ஒரு பரபரப்பை ஏற்படுத்தக் காரணங்களாக இருந்தன!

நம் கல்லூரியைப் பொறுத்தவரை படித்துச் சென்ற மாணவர்களும் ஆசிரியர்களும் நம் கல்லூரியின் பாரம்பரியம், heritage என்று அடிக்கடி பேசுவதுண்டு. நானும் என் 33 வருட அமெரிக்கன் கல்லூரி வாழ்வில் பல முறை அதனைக் கண்டிருக்கிறேன்; அனுபவித்திருக்கிறேன். 19-ம் தேதியும் அப்படி ஒரு நிகழ்வினைக் கண்டேன் கல்லூரியில் அறிவிக்கப்பட்டிருந்த படி தேர்வுகள் எவ்வித மாற்றமோ, குழப்பமோ இல்லாதவாறு ஒழுங்காக அமைதியாக எப்போதும்போல் நடந்து கொண்டிருந்தன – வெளியே இருந்த பரபரப்பு தேர்வு எழுதும் மாணவர்களைப் பாதிக்காதவாறு இருந்தது. தேர்வு எழுத வந்த மாணவர்கள் நேரே தேர்விடங்களுக்குச் சென்று தேர்வு எழுத, hall ticket வழங்குவதும் முறையாகச் செயல்பட, அன்று தேர்வு இல்லாத மாணவர்கள் மட்டுமே கல்லூரியைக் காக்கும் வேலையில் ஈடுபட்டார்கள். அதோடு ஆசிரியர்களும் அவ்வப்போது தேர்வு உள்ள வகுப்பு மாணவர்களைத் தேர்வு எழுத அனுப்பிய வண்ணம் இருந்தனர். எனக்கே மிக்க ஆச்சரியமாக இருந்தது.

பரபரப்பான அந்த நாள் முழுவதும் இன்னும் முடிந்துவிடவில்லையே! பகல்நேரத்தில் இருந்த பரபரப்பின் முழு சாரமும் அந்த இரவின் நிகழ்வுகளில்தான் நடந்தேறின. வேதனையான, சோதனையான இரவு ….

''இதுபோன்ற நெருக்கடியான சூழலை நாம் முன்பு ஒருபோதும் சந்தித்ததில்லை. வேகமாகச் செயல்பட வேண்டிய தருணம். இது ஒரு போர்க்களம். இதில் வெற்றி பெற்றே தீருவோம்...''

- ஓர் அரசியல் தலைவரின் உணர்ச்சி முழக்கமல்ல இது... 'என்னய்யா, இந்த சமாசாரம் உனக்கு தெரியாம போச்சேய்யா' என்று நகைச்சுவையாகப் பேசும் பட்டிமன்ற புகழ் சாலமன் பாப்பையாவிடம் இருந்துதான் இப்படி அனல் வார்த்தைகள் தெறித்திருக்கின்றன.

புகழ்பெற்ற மதுரை அமெரிக்கன் கல்லூரியின் விளையாட்டு மைதானத்தைத்
தனியாருக்கு விற்கப் போவதாகப் பரவிய தகவலையடுத்து, அதிர்ச்சியடைந்த அமெரிக்கன் கல்லூரியின் முன்னாள் பேராசிரியர்கள் மற்றும் முன்னாள் மாணவர்கள் கடந்த 16-ம் தேதி மாலை நடத்திய ஆலோசனைக் கூட்டத்தில்தான் சாலமன் பாப்பையா இப்படி முழங்கினார். இவர் அந்தக் கல்லூரியின் முன்னாள் தமிழ்த்துறைப் பேராசிரியர்.

அமெரிக்கன் கல்லூரி 127 ஆண்டு காலப் பாரம்பரியம் மிக்கது. 1881-ல் 'அமெரிக்கன் போர்ட் ஆஃப் கமிஷனர்ஸ் ஃபார் ஃபாரின் மிஷன்' என்ற அமைப்பால் இந்தக் கல்லூரி நிறுவப்பட்டது. இதன் சொத்துக்களை மதுரை
சி.எஸ்.ஐ. பேராயரான கிறிஸ்டோபர் ஆசிர், தனியா ருக்கு விற்க முயற்சிப்பதாக இப்போது குற்றச்சாட்டு எழுந்துள்ளது.

ஆலோசனைக் கூட்டத்தில் பேசிய சாலமன் பாப்பையா, ''பேராயர் கிறிஸ்டோபர் ஆசிர் தன்னிச்சையாக முடிவெடுத்து தன் மருமகன் தவமணி கிறிஸ்டோபரை கல்லூரியின் நிதிக் காப்பாளராக நியமித்துள்ளார். அவரை வைத்துக் கொண்டு பேராயர் நிறைய தவறுகளைச் செய்கிறார். கடந்த இரண்டு ஆண்டுகளில் அந்தக் கல்லூரியின் கையிருப்பாக இருந்த மூன்றே கால் கோடி ரூபாய் செலவாகி இருக்கிறது. இப்போது அதே தொகை கடனாக உள்ளது. இந்த நிலையில் கல்லூரி மைதானத்தை விற்க திட்டமிட்டுள்ளனர். உயிரே போனாலும் சரி... கல்லூரியின் ஒரு அங்குலத்தைக்கூட விற்க அனுமதிக்க மாட்டோம்...'' என்று அனல் பறக்கப் பேசினார்.

இதைத் தொடர்ந்து, அந்தக் கூட்டத்திலேயே 'அமெரிக்கன் கல்லூரி பாதுகாப்பு கமிட்டி' உருவாக்கப்பட்டது. கமிட்டி தலைவராக சாலமன் பாப்பையாவும் நிர்வாகிகளாக அமெரிக்கன் கல்லூரியின் முன்னாள் பேராசிரியர்கள் வின்ஃப்ரட், பார்த்தசாரதி, வசந்தன், 'பீப்பிள்ஸ் வாட்ச்' இயக்குநர் ஹென்றி டிஃபேன் ஆகியோரும் தேர்ந் தெடுக்கப்பட்டிருக்கிறார்கள்.

கூட்டத்தில் பேசிய ஹென்றி டிஃபேன், ''மதுரையில் பல்வேறு வகையிலும் செல்வாக்கு பெற்ற ஒரு கும்பலோடு கைகோத்துக் கொண்டு பேராயர் கிறிஸ்டோபர் ஆசிர், அமெரிக்கன் கல்லூரி யைக் கூறுபோட்டு விற்க முயல்கிறார். இந்தக் கல்லூரியின் ஒரு சென்ட் நிலம் அந்தக் கும்பலிடம் சென்றுவிட்டாலும் மதுரையிலுள்ள புகழ்பெற்ற அத்தனை பொதுச் சொத்துக் களையும் அந்தக் கும்பல் அபகரிக்கத் தயங்காது. மக்கள் சக்தியைத் திரட்டி இதை நாம் தடுத்தாகவேண்டும்...'' என்றார் காட்டமாக.

முன்னாள் பேராசிரியர் வின்ஃப்ரட் பேசும்போது, ''கல்லூரியின் முதல்வராகவும், செயலாளராகவும் சின்னராஜ் ஜோசப் ஜெயக்குமார் இருக்கிறார். கல்லூரியின் சொத்துக்களை விற்க வேண்டுமானால் இவருடைய ஒப்புதல் தேவை. ஆனால், சொத்தை விற்க அவர் ஒப்புக்கொள்ளவில்லை. அவரை நீக்கினால் சொத்துக்களை எளிதாக விற்று விடலாம் என்று பேராயர் கிறிஸ்டோபர் ஆசிர் மனக்கணக்குப் போடுகிறார். இதனால் அவர் கடந்த 12-ம் தேதி கல்லூரி முதல்வர் இல்லாத நேரமாகப் பார்த்து தன்னுடைய மருமகனையும் துணை முதல்வர் ஜார்ஜ் செல்வக்குமாரையும் ஏவிவிட்டு போலீஸாரையும் கல்லூரிக்குள் வரவழைத்து முதல்வரின் அறைக்குப் பூட்டுப் போட்டிருக்கிறார்'' என்று குற்றம் சாட்டினார்.

மற்ற முன்னாள் பேராசிரியர்களான பார்த்தசாரதியும் வசந்தனும், ''இம்மாதம் 19-ம் தேதி கல்லூரி நிர்வாகத்தில் 100 சதவிகிதம் கிறிஸ்துவர்கள் மட்டுமே இருக்கும்படியான ஒரு குழு அமைத்து கல்லூரியை மதுரை-ராமநாதபுரம் திருமண்டலத்துடன் இணைக்க முயற்சிக்கிறார் பேராயர். அதே நாளில் நாமும் மதுரை தல்லாகுளத்தில் இந்த சூழ்ச்சியை மக்களிடம் விளக்கும் விதமாகக் கூட்டம் நடத்துவோம்'' என்றனர்.

இந்தக் குற்றச்சாட்டுகள் தொடர்பாக கல்லூரியின் முதல்வர் சின்னராஜ் ஜோசப் ஜெயக்குமாரிடம் பேசினோம். ''பேராயர் என்பவர் இந்தக் கல்லூரியின் ஆட்சி மன்றக் குழுவில் ஒரு கௌரவப் பதவியில் இருப்பவர் மட்டுமே. ஆனால், அவர் தன்னைக் கல்லூரியின் உயர் பொறுப்பில் இருப்பவர் போலவும், அதிகாரம் மிக்கவர் போலவும் நினைத்துக்கொண்டு தன்னிச்சையாகச் செயல்பட்டு, கல்லூரியின் சொத்துக்களை விற்க முயல்கிறார். இதை ஒருபோதும் அனுமதிக்க முடியாது'' என்றார்.
பேராயர் கிறிஸ்டோபர் ஆசிரிடம் அவருடைய மொபைல் போனில் தொடர்புகொண்டு பேசினோம். ''நான் பேராயராகப் பொறுப்பேற்ற பின் இரண்டு பி.எட். கல்லூரிகள், ஒரு நர்ஸிங் கல்லூரி, ஒரு பல் மருத்துவக் கல்லூரி ஆகியவற்றை ஏற்படுத்தியிருக்கிறேன். இப்படிப் புதிய சொத்துக்களை உருவாக்கும் நான், இருக்கும் சொத்துக்களை விற்பேனா..? அதுவுமில்லாமல் நிதி மற்றும் சொத்துப் பராமரிப்பு கமிட்டிக்குப் பொறுப்பானவர் முதல்வர்தான். சொத்துக்களை விற்க எனக்கு அதிகாரம் இல்லை. முதல்வரின் நிர்வாகச் செயல்பாடுகள் திருப்திகரமாக இல்லை. இதுவரை அவர் கடந்த நிதியாண்டுக்கான பட்ஜெட்டையே தாக்கல் செய்யவில்லை. இந்த நிலையில் அவர் வெளிநாடு செல்ல விடுப்பு கேட்டார். 'வெளிநாடு சென்று திரும்பும்வரை பொறுப்புகளைத் துணை முதல்வரிடம் கொடுத்துவிட்டுச் செல்லுங்கள்' என்றேன். அதற்குள் நான் சொத்துக்களை விற்க முயல்வதாகக் கற்பனையாக என் மீது குற்றம் சாட்டுகிறார். மற்றபடி, கல்லூரி முதல்வரின் அறைக்குப் பூட்டுப் போடப்பட்டது தொடர்பாக எனக்கு எதுவும் தெரியாது'' என்றார்.

இதற்கிடையே கல்லூரி முதல்வர் சின்னராஜ் ஜோசப் ஜெயக்குமார், 'தல்லாகுளம் க்ரைம் இன்ஸ்பெக்டர் ஜஸ்டின் பிரபாகரன் அத்துமீறி கல்லூரிக்குள் புகுந்து, துணை முதல்வருடன் சேர்ந்துகொண்டு என் அறையைப் பூட்டினார்' என்று போலீஸ் கமிஷனர் நந்தபாலனிடம் புகார் கொடுத்திருக்கிறார். முன்னாள் பேராசிரியர்கள் மற்றும் முன்னாள் மாணவர்கள் கொண்ட அமெரிக்கன் கல்லூரி பாதுகாப்பு கமிட்டியினர், 'அரசியல்-அதிகார சக்திகளின் உதவியோடு அமெரிக்கன் கல்லூரியை ஆக்கிரமிக்க முயற்சி நடக்கிறது. இதற்குப் பேராயர் கிறிஸ்டோபர் ஆசிர் உடந்தை. எனவே, எங்களுடன் இணைந்து கல்லூரியைக் காப்பாற்றுங்கள்' என்று முக்கிய பிரமுகர்கள், கல்லூரி மாணவர்களுக்கு எஸ்.எம்.எஸ்-களை அனுப்பிவருகின்றனர்.

19th ஏப்ரல் ... இரவு

A TENSE DAY ...ORDEAL CONTINUES .........
 
 

Time now is 12.30 (IST). I am at home. Got a phone call few minutes back from colleagues who stayed put in the campus after a complete tension-filled day.

The information that i got is this:

At 7.30 p.m. Bursar, Christopher had forcefully entered the campus, breaking the lock of the front gate. Tried with a group of thugs to enter Principal's room which was halted by a few staff who had been there around our Main Hall. By this time students from all hostels - including ladies' hostel - rushed to Main Hall and sat in the verandah and started shouting slogans in support of the college. In response, girl students from dental college (Daughter-bishop is the principal of that institution.) and little girls from O.C.P.M. School under Bishop have been brought in and they were sitting at the front gate inside the campus blocking the entry. Neither people can come in or go out.

Police officials who have come to "compromise" are putting the very first condtion - our studnents should go back to hostels. And then staff can lock the principal's office and go away. Then they will ask Bursar and his cronies to leave the place. It is nothing but leaving a good chance for the Bursar and his cronies to break open and occupy Principal's office without any problem. Police were found to be very cooperative and supporting earlier at the higer level. But now the lower level police who have come for bandobust are of, it appears, a different ilk. Their (in)direct support appears to be with the Bursar. பணம் பாதாளம் மட்டும் பாயுமாமே; பத்தும் செய்யுமாமே!

Principal contacted the District Collector, Mr. Jawahar. After Collector's emmissary, the R.D.O. came the situation is slightly better, I hear.

This is going to be a long night for my colleagues and students who are keeping the evil forces of the Bursar at bay ...

ஒரு விளக்கம்

19- தேதி தயாரிக்கப்பட்டு இருந்த குறு அறிக்கை கல்லூரியின் முன் இருந்தும், மற்றும் மெட்ரோ உணவு விடுதி முன்பு இருந்தும், தபால் நிலையத்தின் முன்பிருந்தும் மக்களிடையே விநியோகிக்கப் பட்டன.

அந்தக் குறு விளக்க அறிக்கையின் அடக்கம் இதுவே:

அமெரிக்கன் கல்லூரி பேராயரின் சொத்தா? மக்கள் சொத்தா?
- ஒரு விளக்கம்.

American Board of Commissioners for Foreign Mission எனும் அமைப்பால் 1881-ல் அமெரிக்கன் கல்லூரி ஒரு கிறித்துவக் கல்லூரியாக நிறுவப்பட்டது.
1904-ல் பசுமலையிலிருந்து மதுரைக்கு அது இடம் பெயர்ந்த போது, “உயர்கல்வியை எல்லாத் தரப்பினருக்கும் வழங்கும் ஒரு கிறித்துவ நிறுவனம் இது” என்ற குறிக்கோளை மறைதிரு ஜம்புரோ எனும் இறையடியார் முன் வைத்தார். மதுரை நகருக்குள் கல்லூரி வருவதற்கு முனைப்பாயிருந்த ஜம்புரோ அவர்களின் குறிக்கோள் இன்றுவரை பின்பற்றப்பட்டு வருகிறது.

1934-ல் ABCFM அமெரிக்கன் கல்லூரியைத் தன்னாட்சி பெற்ற நிறுவனமாக மாற்ற முடிவெடுத்த போது, அதன் முதல் ஆட்சிமன்றக் கூட்டத்திலேயே அதன் அனைத்து உரிமைகளையும் சொத்துக்களையும் ஆட்சிமன்றக் குழுவிற்கு மாற்றி, அது ஒரு பதிவு செய்யப்பட்ட சொசைட்டியாக மாற்றப்பட்டது.

1949-ல் ABCFM-ன் அமெரிக்க–மதுரா மிஷன் CSI தென்னிந்தியத் திருச்சபையோடு இணைந்தாலும், அமெரிக்கன் கல்லூரி அதன் தனித்த அடையாளங்களோடு தனி சொசைட்டியாகவே இன்றளவும் இயங்கி வருகிறதேயல்லாமல் அது ஒரு போதும் திருமண்டலத்திற்குச் சொந்தமானதாக மாறவில்லை.

அமெரிக்கன் கல்லூரியின் ஆட்சிமன்ற அரசியலமைப்புச் சட்டமானது மதுரை-இராமநாதபுர திருமண்டலப் பேராயரை பதவி வழி ஓர் உறுப்பினராகவே அங்கீகரித்துள்ளது. அவர் ஆட்சிமன்றக் கூட்டத்தைத் தலைமை தாங்கி நடத்தும் உரிமை மட்டுமே உள்ளவர். இதைத் தவிர கல்லூரியை நிர்வகிக்கும் அன்றாட நடவடிக்கைகளில் அவர் பங்கு பெற இயலாது; கூடாது. மாறாக, அவ்வுரிமைகள் அனைத்தும் முதல்வரும் செயலருமாக இருப்பவருக்கே கடந்த 127 ஆண்டுகளாக வருமுன் காணும் ஆற்றல் மிக்க ஆட்சிக் குழுவினரால் வழங்கப்பட்டு உள்ளது.

கிறிஸ்துவ மதிப்பீடுகளை உள்ளடக்கிய பரந்துபட்ட கல்வியைச் சமூகத்தின் எல்லாத் தரப்பினரும் பெற வேண்டும் என்ற உயரிய குறிக்கோளையுடைய முன்னோர்கள் இயற்றிய அமெரிக்கன் கல்லூரியின் அரசியலமைப்புச் சட்டத்தை பெரிதும் மதித்தே இதுவரை அத்தனை பேராயர்களும் இயங்கி வந்துள்ளனர்.

ஆனால் தற்போதைய பேராயர், மறைதிரு கிறிஸ்டோபர் ஆசிர் அவர்கள் நூறாண்டுகளைக் கடந்த இதன் உயர்ந்த பாரம்பரியத்தைச் சிதைத்து தன் சொந்த விருப்பங்களை நிறைவேற்றிக் கொள்ள முனைந்துள்ளார்.
அமெரிக்கன் கல்லூரி CSI திருமண்டலத்திற்குச் சொந்தமானது என்று தொடர்ந்து பிரச்சாரம் செய்து வந்த பேராயர் அவர்கள் தன் சொந்த மருமகன் டாக்டர் தவமணி கிறிஸ்டோபரைப் பல மூத்த பேராசிரியர்களைப் புறக்கணித்து, நிதிக்காப்பாளராக நியமிக்க ஆட்சிமன்றக் குழுவைப் பயன்படுத்தி இருக்கிறார்.

அவருரைய ஆதரவாளர்களை தன் சொல்லிற்குக் கட்டுப்பட வேண்டிய நிலையில் உள்ளவர்களைத் தன் நோக்கத்தை நிறைவேற்றிக் கொள்ள உதவும்படி ஆட்சி மன்றக் குழுவிற்குள் புகுத்தி இருக்கிறார்.

*இத்தகைய நெருக்கடியான சூழ்நிலையில் அமெரிக்கன் கல்லூரியின் ஆசிரியர் கழகமான MUTA-வும் ஆசிரியர்களும் கல்லூரியைக் காக்கும் முயற்சியில் தற்போதைய முதல்வர் டாக்டர் சின்னராஜ் ஜோசப் ஜெயக்குமாருடன் நிற்பதாக உறுதியளித்துத் தீர்மானங்கள் நிறைவேற்றியுள்ளனர்.

*இந்நிலையில் அமெரிக்கன் கல்லூரியின் முன்னாள் மாணவர்கள், பேராசிரியர்கள், பொதுநல விரும்பிகள் ஆகியோர் மதுரையின் பெருமைமிக்க பாரம்ப்பரியச் சின்னங்களுள் ஒன்றாக விளங்கும், மதுரையின் அனைத்து மக்களுக்கும் உரிமையான அமெரிக்கன் கல்லூரியைப் பாதுகாக்கும் புனிதப் பணியில் இணைய அழைக்கிறோம்.

Dear Friends of the American College,


Our Alma matter is in trouble. It needs your help. It needs you badly to save it from greed.

All along our life, we are proud of our college and its tradition for enriching our lives through the experiences we gained from our beloved teachers and good friends. Now, our pride and our heritage is at stake.
Let me explain, in case if you are not aware of the recent developments.

Church is for the society
Unfortunately, the Bishop of the Madurai-Ramnad diocese(Christopher Asir) does not believe in serving the society . After assuming the role of Bishop, he willfully subverted church functions to suit his (and his family's) favour (press reported many of them). No individual had tarnished the image of the diocese like Mr. Asir.
Not satisfied with the self-aggrandizement, he managed to appoint his son-in-law(Davamani Christopher) as the bursar of our college. This allowed him to access the financial records and assets of the college.

The pseudo-religious bishop, his kin and a group of stooges (financial beneficiaries), hatched a plan to rake millions out of the College properties. And they want to get rid of anyone standing in their way. They even enacted an ugly drama at the campus. Overnight, they removed the Principal (Dr.Chinnaraj Joseph) from the chair and made their stooge (Mr. George Selva kumar) as the principal-in-charge. It is illegal as per the college constitution. Bishop does not have any right to interfere in the college administration except heading the Governing Council of our college. It is only a respectable and figure-head position.
But why would they do this? They want to build a shopping mall in our college space! Can you believe it?

Shopping mall, no playground
Now, the bishop assumed the role of a real-estate agent, wants to build a mall in place where the playground is located. He wants to change the ownership to land sharks for a 99 years lease. A wide propaganda in the church that all these acts are done with much prayer to make this campus as a 'typical Christian College'. It is an “accepted norm” to get money for appointments in the Diocesan schools under the direct control of Bishop. If only they can extend the same in our college, how fast their coffers could fill …!

Against the muscle power
They even brought police inside campus to create panic and confusion, but this plan was foiled, as the staff joined hands showing their solidarity and support to Principal and also to dare the police. This event eventually has helped us to organize our loyal staff to show their solidarity for our great institution. In addition, a number of well wishers who hold posts in the government, police and in the legal front, apart from the vibrant alumni are coming forward to join the struggle and to show their solidarity to our college.

Save the college
Today a member of the Governing Council has resigned his membership enabling us to get majority. There are 7 members of the Governing Council now, who are interested in protecting the interests of the college, whereas there are 6 members who have chosen to be the Bishop’s supporters. We hope and pray sincerely that our labor may not go in vain to preserve and promote the rich heritage and the great contributions of the missionaries.

At a felicitation function for one of our prestigious alumnus, an Old Students Meet has been organized on the 17th April 2008 at Chennai with a press meet. We hope that most of the Central Government Officers, Media Personnel, Professors of various colleges and others will extend their supporting hands to the "SAVE AMERICAN COLLEGE MOVEMENT ". This movement may aid in making the college more independent and strong.

How can you help?
You can help by spreading this message across to yours friends and peers. We have to make the friends of our college know Bishop’s wrong-doings and demand transparency in functioning of the diocese and college. Let us join together to make a new revised constitution so that the exploiters who use religion (Christianity) as a tool to keep the masses in constant fear of God for their own wicked interests, may not succeed.
